The purchase of your travel booking constitutes a contractual agreement between the traveler and the agency, Beyond Horizons Travel, LLC and/or its agents.
Travel Agent:
Beyond Horizons Travel, LLC and/or its agents acts as a travel agent only. We sell various travel-related products on behalf of numerous transport and accommodation service providers, including, but not limited to, airlines, coach, rail, cruise line operators, and hotels. Beyond Horizons Travel, LLC and/or its agents does not own, operate, manage, or control these independent suppliers of services and is not liable for their acts or omissions. Beyond Horizons Travel, LLC and/or its agents’ obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We are not responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. Requests cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific travel service provider, not against Beyond Horizons Travel, LLC and/or its agents. Conditions can change rapidly in a country at any time. Therefore, it is your responsibility to be aware of current events, by checking the USA Government Travel advisories for your intended destination at https://travel.state.gov/content/travel.html
Important Conditions:
In some cases, prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. By making a deposit for your booking, you expressly acknowledge your acceptance of these conditions (i.e., increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase.
Deposit and Final Payment:
At the time of booking, you will be required to pay a minimum deposit, as set forth by the travel service provider. This deposit may be non-refundable. In such a case, you will be informed prior to making your deposit. The service provider may require further deposits. Final payment date must be strictly observed, to avoid automatic cancellation by the travel service provider. Please be aware that Beyond Horizons Travel, LLC and/or its agents accepts no responsibility for any loss resulting from any automatic cancellation by a travel service provider. Any such loss is solely the responsibility of the traveler. Some airfares or services must be paid in full at the time of booking. Beyond Horizons Travel, LLC and/or its agents accepts cash and checks only. Debit or credit cards payments are processed by the travel service provider. Should you wish to make payments by debit or credit card, we will require you to read and sign a credit card charge authorization form.
Credit Card Transactions:
If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the travel service provider, and not against Beyond Horizons Travel, LLC and/or its agents. If the credit card is passed through Beyond Horizons Travel, LLC and/or its agents to the travel service provider and you seek to chargeback your payment from the travel service provider, you agree to be held liable and indemnify Beyond Horizons Travel, LLC and/or its agents against this chargeback from the travel service provider. If Beyond Horizons Travel, LLC and/or its agents incurs any costs, including but not limited to attorneys’ fees to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to Beyond Horizons Travel, LLC and/or its agents via money order or cash immediately.
Baggage Fees:
Additional fees for baggage may apply. Please contact your airline or refer to its website for detailed information regarding its checked baggage policies.
Cancellation:
Please be aware that many travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking that you cancel, you agree to indemnify us for the amount of that fee or charge.
Travel Protection:
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by Beyond Horizons Travel, LLC and/or its agents to you constitutes a binding assurance or promise about the insurance. Beyond Horizons Travel, LLC and/or its agents is not an insurance company and has no responsibility for the submission, payment, or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.
Travel Documents:
Travel documents include, without limitation, airline tickets, hotel vouchers, tour vouchers, or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a travel service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings on your documentation will be your responsibility if we are not advised at the time of booking. Please reconfirm your flights at least 24 hours prior to departure.
Passports and Visas:
All individuals departing from the United States of America must be in possession of a valid passport. Please check that your passport is valid for at least 6 months beyond your intended travel time. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State or the representative government agency of the country to which you are traveling to confirm the requirements for visas and/or other requirements for admission to your destination. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.
REAL ID:
Beginning October 1, 2021, if you plan to use your state-issued ID or license to fly within the U.S., it is your responsibility to make sure it is REAL ID compliant. If you are not sure if your ID complies, please check with your local state department of motor vehicles, or visit www.tsa.gov/real-id
Force Majeure:
Beyond Horizons Travel, LLC and/or its agents shall not be responsible for failure to perform any of its obligations under this Agreement during any period in which such performance is prevented or delayed due to Force Majeure, nor for changes to or terminations of your trip due to Force Majeure. “Force Majeure” refers to any event, including but not limited to severe weather, fire, flood, mudslides, earthquakes, war, labor disputes, strikes, epidemics, World Health Organization’s advisories and/or alerts, disease, pandemic, virus, illness, Center for Disease Control’s advisories and/or alerts, U.S. State Department’s advisories and/or alerts, any order of any local, provincial or federal government authority, interruption of power Services, terrorism or any other causes beyond the control of Beyond Horizons Travel, LLC and/or its agents.
Very rarely, you may be forced by "force majeure" to change or terminate your trip after departure but before the scheduled end of your trip. This is unlikely but if this situation does occur, we regret we will be unable to make any refunds (unless we obtain any refunds from our Suppliers), pay you any compensation, or meet any costs or expenses you incur as a result. Beyond Horizons Travel, LLC and/or its agents reserves the right to cancel any services described in a trip itinerary due to Force Majeure.
Liability:
Beyond Horizons Travel, LLC and/or its agents is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, Beyond Horizons Travel, LLC and/or its agents is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services, whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities or amenities, such as air-conditioning systems in public places, hotels, and motor coaches may not be up to U.S. standards. If due to weather, flight schedules, or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers, and meal costs. Baggage is entirely at owner's risk. You specifically agree that Beyond Horizons Travel, LLC and/or its agents is not liable for any consequential loss or damage.
Additional Fees:
Additional taxes and surcharges that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers. Most properties and vehicle rental/leasing companies require a credit card imprint at check-in.
Responsibility:
We always do our best to make sure your travel arrangements are satisfactory. However, Beyond Horizons Travel, LLC and/or its agents does not own or operate any entity that provides goods and services for your travel, including without limitation lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers, or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated with Beyond Horizons Travel, LLC and/or its agents.
Health and Special Requirements:
It is your responsibility to ensure you are aware of any health requirements, health advisories, or health travel restrictions applicable to your travel destinations and to ensure that you carry all necessary vaccination documentation. Beyond Horizons Travel, LLC and/or its agents is not responsible for providing you with this information. Travel carriers and local authorities at travel destinations may require specific testing prior to boarding and/or upon arrival at your destination, including, but not limited to, a temperature check as a result of the COVID-19 pandemic. You may be denied entry onto your carrier and/or entry upon arrival at your destination, or be required to self-quarantine at your destination and upon your return to the United States. You must comply with local government regulations. Additional costs are your responsibility. Flight Confirmation:
We strongly suggest that clients reconfirm exact flight times with the carrier prior to departure. Air travelers are required to check in at least 2 hours prior to departure time for domestic flights and 3 hours for international flights and must report to the gate at least 30 minutes prior to departure time. Failure to comply may result in the loss of the seat to another passenger.
International Flights:
Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transport disinfection website. https://www.transportation.gov/airconsumer/spray
Refusal of Service:
Service providers reserve the right to refuse service to travelers at their sole discretion, including, without limitation, if the traveler: (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs, or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior. Beyond Horizons Travel, LLC and/or its agents assumes no liability for the acts of the travel service provider in refusing service.
Impossibility of Performance:
No refund(s) will be issued for cancellations due to actual or threatened terrorist events. If travel plans are delayed or cancelled for any reason there will be no refunds issued by Beyond Horizons Travel, LLC and/or its agents. Please note that a ‘trip’ or ‘booking’ often consists of multiple components, each of which may carry its own cancellation penalties (example: an airline ticket, a pre-trip hotel night, a multi-day adventure vacation by a tour operator, etc., all of which may be subject to a different set of cancellation policies).
Privacy Policy:
Beyond Horizons Travel, LLC and/or its agents is committed to protecting the privacy and confidentiality of your personal information. Our Privacy Policy is available for viewing on request.
Electronic or Handwritten Signature:
Both parties agree that you may acknowledge and agree to these Terms: (i) electronically; (ii) by handwritten signature; (iii) by any other electronic means, including, without limitation, via email acceptance of these Terms; or (iv) by your implied consent deemed via your actions, which shall include without limitation the payment of the invoice and/or your use of the services provided by Beyond Horizons Travel, LLC and/or its agents or any other travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgement and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.
Governing Law:
The construction, validity, and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of the Commonwealth of Virginia, without giving effect to its conflict of law principles, and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of the Commonwealth of Virginia with respect to any legal proceedings relating to these Terms.
Beyond Horizons Travel, LLC and/or its agents is not responsible for typographical errors.
1. Background
This Privacy Policy sets out how Beyond Horizons Travel, LLC and/or its agents protect the privacy of your personal information. We need to collect, use and disclose personal information in order to perform our business functions and activities, including making and managing travel bookings on behalf of our customers. We are firmly committed to protecting the privacy and confidentiality of personal information and to maintaining various physical, electronic and procedural safeguards to protect personal information in our care.
By providing personal information to us (either directly or allowing another person to do so on your behalf), you agree that this Policy will apply to how we handle your personal information and you consent to us collecting, using and disclosing your personal information as detailed in this Policy. If you do not agree with any part of this Policy, you must not provide your personal information to us. If you do not provide us with your personal information, or if you withdraw a consent that you have given under this Policy, this may affect our ability to provide services to you or negatively impact the services we can provide to you. For example, most travel bookings must be made under the traveler's full name and must include contact details and appropriate identification (e.g. passport details). We cannot make bookings for you without that information.
2. What personal information do we collect?
Personal information generally means information which relates to a living individual who can be identified from that information, or from that information and other information in a person's possession, including any expression of opinion, whether true or not, and whether recorded in material form or not, about an identified or reasonably identifiable individual, and any indication of intention in respect of an individual. Generally, the type of personal information we collect about you is the information that is needed to facilitate your travel arrangements and bookings and to arrange travel related services and/or products on your behalf. For example, we may collect details such as your name, residential/mailing address, telephone number, email address, credit/debit card details (including card type, card number, security number and expiry date), passport details, loyalty program/frequent flyer details, information about your dietary requirements and health issues (if any), and other details relevant to your travel arrangements or required by the relevant travel service provider(s) (e.g. airlines and accommodation or tour providers).
3. How do we collect personal information?
We will collect personal information directly from you unless it is unreasonable or impracticable to do so. Generally, this collection will occur when you deal with us either in person, by telephone, letter, facsimile, email, or when you visit our website. We may collect personal information about you when you purchase or make inquiries about travel arrangements or other products and services.
In some circumstances, it may be necessary for us to collect personal information about you from a third party. This includes where a person makes a travel booking on your behalf which includes travel arrangements to be used by you (e.g. a family or group booking or a travel booking made for you by your employer). Where this occurs, we will rely on the authority of the person making the travel booking to act on behalf of any other traveler on the booking. By providing your personal information to us, either directly or through a family member, employer or other agent or representative in connection with a travel booking or related service, you will be deemed to have consented to your personal information being collected by us and used and disclosed in accordance with this Policy. Where you make a travel booking on behalf of another person (e.g. a family or group booking or a travel booking made for an employee), you agree you have obtained the consent of the other person for Beyond Horizons Travel, LLC and/or its agents to collect, use and disclose the other person's personal information in accordance with this Policy and that you have otherwise made the other person aware of this Policy. You should let us know immediately if you become aware that your personal information has been provided to us by another person without your consent or if you did not obtain consent before providing another person's personal information to us.

Where you contact us in relation to a travel booking or query, the purpose for which we collect your personal information is generally to provide you with travel advice and/or to assist you with booking travel and/or travel related products and services. When we book and otherwise arrange travel related products and services for you, we usually act as agent of the relevant travel service providers (e.g. for a hotel). In this case, we process your personal information as necessary so as to provide the services you requested from us. This usually includes collecting personal information about you both for our internal purposes as described in this Policy and for the travel service provider for whom we act as agent for their internal purposes (e.g. to provide you with the booked services). For example, if you book a flight through us, then we use your personal information to enable your flight to be booked and disclose it to the airline to enable the airline to provide the flight service to you.
We may therefore share your information with our travel service providers such as hotel, airline, car rental, or other providers, who fulfil your travel bookings. We act as agent for or on behalf of many travel service providers around the world, so it is not possible for us to set out in this policy all of the travel service providers for whom we act or their locations. We may disclose your personal information to certain overseas recipients, as set out below, which we will do in accordance with your local data protection laws. It is possible that information will be transferred to an overseas recipient (other than any of our overseas related entities) located in a jurisdiction where you will not be able to seek redress under your local data protection laws and that does not have an equivalent level of data protection as in your jurisdiction. To the extent permitted by your local data protection laws, we will not be liable for how these overseas recipients handle, store and process your personal information.
(a) Travel service providers located overseas.
In providing our services to you, it may be necessary for us to disclose personal information to relevant overseas travel service providers. We deal with many different travel service providers all over the world, so the location of a travel service provider relevant to your personal information will depend on the travel services being provided. The relevant travel service providers will in most cases receive your personal information in the country in which they will provide the services to you or in which their business or management is based.
(b) Our third party service providers located overseas.
We may also disclose your personal information to third parties located overseas in connection with facilitation of your travel booking and/or to enable the performance of administrative and technical services by them on our behalf.

Beyond Horizons Travel, LLC has implemented appropriate technical and organizational measures in order to protect the personal information it holds from loss and misuse, and from unauthorized access, modification, disclosure and interference. Beyond Horizons Travel, LLC regularly reviews security technologies and will strive to protect your personal information as fully as we protect our own confidential information. Beyond Horizons Travel, LLC and/or its agents is not responsible for any third party’s actions or their security controls with respect to information that third parties may collect or process via their websites, services or otherwise. We will destroy or de-identify personal information once we no longer require it for our business purposes, or as required by law.
8. Your rights in relation to the personal information we collect.

In any of the situations listed above, we may request that you prove your identity by providing us with a copy of a valid means of identification in order for us to comply with our security obligations and to prevent unauthorized disclosure of personal information.
